PLEASE, READ CAREFULLY THESE CONDITIONS
These General Terms and Conditions shall expressly govern the relationships that arise between Chuloo's Santander S.L.U., Barrio La Central s/n, nave 8-A, 39608, Cacicedo, Cantabria, Spain, with VAT number: B39701420 (hereinafter, "Chuloo's Santander”) and third parties (hereinafter, the “users”) who register and/or purchase products through the official website online store of Chuloo's Santander (www.savageculture.com, hereinafter the "Store"). The object of the Store is the sale of textile items. The user must be informed that the company operates from Spain.
2. OBLIGATIONS OF THE USER
2.1 The User agrees to use the Store to purchase the Products and to use each of the services of the Store diligently under the law, morality, public order and provisions hereof. They must also prevent themselves from using the said Products or services in any way that may prevent, damage or deteriorate the normal operation and use of the Store on the part of the Users or that may harm or cause damage to Chuloo's Santander goods and rights as well as to those corresponding to its suppliers, Users or, in general, any third party. In addition, the user declares being legally of age.
3. PRODUCTS AND PRICES
3.1 Chuloo's Santander reserves the right to decide, at all times, the Products that are offered to the Users through the Store. In addition, Chuloo's Santander may at any time add new Products to the ones offered or included in the Store, understanding that unless otherwise provided, such new Products shall be governed by the provisions of these General Terms and Conditions. In addition, Chuloo's Santander reserves the right to stop providing or facilitating the access and use at any time and without prior notice of any of the different types of Products that are offered in the Store.
3.2 Products included in the Store shall match, as truly as the website display technology allows, the Products effectively offered. The characteristics of the Products and their prices are displayed in the Store. Unless otherwise indicated, the prices given in the Store are in Euros VAT included.
3.3 The company reserves the right to cancel any order if an error is found in such order (such as errors in price, fraudulent use of discounts or payment methods, and similar nature).
4. ORDER PROCESSING AND PAYMENT
4.1 Chuloo’s Santander shall send an email to the user, confirming the purchase within a maximum period of twenty-four (24) hours. This email shall assign a reference code of the purchase, and detail the characteristics of the Product, its price, shipping & handling costs (if applicable), and data corresponding to the several options regarding the payment of the Product to Chuloo's Santander.
4.2 The User who purchases a Product through the Store must make the payment using the payment options specifically detailed in the Store.
4.3 Chuloo's Santander shall file the electronic documents formalising the contract and shall send a copy to the User once the purchase has been made. The contract shall be drawn up in Spanish. Santander do not register data related to payment, such as numbers of the credit/debit cards.
4.4 The confirmation of the order sent by Chuloo's Santander is not valid as an invoice; it is simply a purchase receipt. Chuloo's Santander shall send the invoice with the Product to which it refers.
4.5 Security in payment: The Store uses security systems to prevent incidence in the payment of the purchase. Credit card details are entered on a secure page and transferred via SSL. The website is the responsible of the transactions, but it does not store data about the methods of payment, as the payment is transferred at the moment of the purchase to the holder’s banking entity site. In addition, the website uses security techniques of information generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorized access to data. In order to carry out these purposes, the User accepts that the provider collects data for purposes of authentication for access control. All recruitment Process or any process which involves the introduction of sensitive personal data (health, ideology,...) are always transmitted through communication protocol secure, so that no third party has access to information transmitted electronically.
5. RIGHT OF WITHDRAWAL
5.1 The User has the right to withdraw, contacting Chuloo's Santander via email at the following address, info@savageculture.com , and cancel the purchase within a maximum period of FOURTEEN (14) calendar days from the reception of the Product. The Product must be sent enclosing the return form duly completed and a copy of the receipt/invoice. The direct cost arisen from the return of the Product will be chargeable to Chuloo's Santander. This return will be in accordance with the instructions that Chuloo's Santander indicates to the User in reply to the notification of their right of withdrawal. The User must return the Product within a maximum period of FOURTEEN (14) days from the reception of the order.
5.2 The withdrawal implies the refund of the paid amount. The refund will be paid using the same payment means the User used to purchase. The period of such refund will be set by law.
5.3 The User shall not be able to exercise their right of withdrawal in the event that the Product is not sent in its original packaging and the Product is not in perfect condition.
6. CUSTOMER SERVICE
6.1 The User may send an email to info@savageculture.com in case of incidence, claim or exercise of their rights.
7. HOME DELIVERY SERVICE
7.1 The territorial scope of sales through the Store is exclusively for the following territories: SPAIN*, GERMANY, AUSTRIA, BELGIUM, FRANCE*, NETHERLANDS, ITALY*, LUXEMBOURG, UNITED KINGDOM*, DENMARK, HUNGARY, POLAND, CZECH REPUBLIC, BULGARIA**, CROATIA**, SLOVAKIA**, SLOVENIA**, ESTONIA**, FINLAND**, GREECE**, IRELAND**, LATVIA**, LITHUANIA**, ROMANIA**, SWEDEN**, so the delivery service will only be for those territories. The Products purchased through the Store will be sent to the delivery address that the User indicates once the payment has been verified, and the delivery time will be thirty (30) days, set by default in the Law. (* - No delivery service in countries or zones with customs duties. ** - Zones with two asterisks may be excluded from Free Shipping promotions). The estimated delivery time in SPAIN is 24h/72h, whereas the estimated delivery time in other European countries is 2-10 working days.
7.2 The Chuloo's Santander delivery service is performed in collaboration with a number of logistics operators of acknowledged prestige. Orders shall not be sent to Post Office Boxes, hotels or any other non-permanent addresses.
7.3 The shipping & handling cost may not be included in the price of the Products. At the time of purchase of the Product, the User shall be informed of the exact shipping & handling costs.
7.4 In case of receiving a damaged product due to transport issues, the User must complain to the transport agency, whose data will be shown in the delivery note. Subsequently, the User must indicate their issue through the customer service, providing the order number and the existing problem. Once received the incidence, a new order will be processed if needed.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY
8.1 The User acknowledges that all elements of the Store and of each of the Products, the information and materials contained therein, the trademarks, the structure, selection, arrangement and presentation of its contents, and the computer programs used in relation to the said Products are protected by intellectual and industrial property rights belonging to Chuloo's Santander or to third parties, and that in regards to these industrial and intellectual property rights the General Terms and Conditions do not give them any other rights than those specifically covered thereof.
8.2 Unless authorised by Chuloo's Santander or, as the case may be, by the third-party holders of the corresponding rights, or except if allowed by law, the User shall not reproduce, transform, modify, disassemble, perform inverse engineering, distribute, rent, lend, make available, or allow access to the public through any way of public communication of any of the elements referred to in the previous paragraph. The User must use the materials, elements and information to which he has access through the use of the Store solely for their own needs, agreeing not to perform whether directly or indirectly, any commercial use of the materials, elements and information obtained thereof.
8.3 The User must prevent himself from avoiding or handling any technical devices established in the Store by Chuloo's Santander or by third parties.
9. DATA PROTECTION
9.1 The Privacy Policy and Data Protection can be consulted in the Privacy Policy section.
9.2. We do not transfer data to other companies to send advertisement and we strictly comply with the Law. See Privacy Policy.
9.3 The User can exercise their rights at any time to access, rectify, opposition or cancellation contacting via mail Chuloo's Santander, Barrio La Central s/n, nave 8-A, 39608, Cacicedo, Cantabria, Spain, or email at info@savageculture.com, enclosing a copy of their identification document or a substitute identification document.
9.4. The answers marked with * in the registration form are obligatory. In case that the User do not answer these questions, the purchase of the selected products will be unable to make.
10. PASSWORDS
10.1 Chuloo's Santander shall provide personal passwords to the user who signs in on the website. These passwords shall be used to have access to the services provided by the Website. The user must keep the passwords under their exclusive liability in the strictest and most absolute confidentiality, therefore being liable for the damages or consequences of any kind that arise from the breach or disclosure of the password. For security reasons, the user may change the telematic access passwords to the services related to the Website at any time. The User agrees to immediately inform Chuloo's Santander of any unauthorised use of their password and of any access to the said password by unauthorised third parties.
11. COOKIES
11.1 Chuloo's Santander uses cookies with the purpose of improving its services, aiding browsing, maintaining security, verifying the identity of the User, aiding access to personal preferences and monitoring the use of the Store. Cookies are files installed on the computer hard drive or in the browser memory in a folder previously configured by the User’s computer operating system for the purpose of its identification.
11.2 Should the User not want a cookie to be installed on their hard drive, they should configure their Internet browser in such a way that it does not accept the said cookies. In the same way, the User may freely destroy the cookies. In the event the User decides to disable the cookies, the quality and speed of the service may diminish, and they may even lose access to some of the services offered in the Store.
12. COMPETENT JURISDICTION AND APPLICABLE LAW
These General Conditions are governed by Spanish law. The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the legal residence of the user.
All aspects that are not foreseen in these General Conditions of Sale will be regulated by the legislation, uses and customs of distance selling and retail in Spain.
